If you are convicted, it is necessary to file an appeal to an appellate court before the deadline for appeals. Your attorney will obtain a transcript of the trial court proceedings and review it carefully for error. The attorney will then prepare a brief stating why your case was unfair making reference to previous court decisions
Your attorney will send a copy of the brief to the appellate court and to the prosecutor. The court will then set a hearing date for the appeal. Your attorney and the prosecutor will appear at the hearing and present arguments to the court. The appellate court judges many ask some questions of the attorneys. After the hearing is over, the appellate court judges will confer among themselves and then issue an opinion either affirming the conviction or reversing it and ordering a new trial with instructions to the trial court.
