We are skilled at preparing petitions to the U.S. Supreme Court for a writ of certiorari. In these petitions we focus on violations of the defendant’s constitutional rights. Upon granting of the writ, we can also prepare the brief to the court and, if you wish, go to Washington to make the oral argument.
This is a little known writ that applies to defendants who have already served a sentence. It is to correct a manifest injustice that cannot be corrected in any other way. An example would be discovery of exculpatory evidence that a prosecutor suppressed. As the defendant is no longer in jail, a writ of habeas corpus is no longer available. With a petition for this writ, it is possible to clear the defendant’s name. This writ can even be requested by an heir to exonerate a deceased defendant of a crime.
